1. Description of Services

ReqOpen provides staffing and recruitment services to connect startups and companies ("Clients") with job-seeking professionals ("Candidates"). Our services include, but are not limited to, sourcing, vetting, and presenting Candidates for permanent, contract, and executive roles.

2. User Obligations

For All Users

You agree to use our Services for lawful purposes only. You will not use the Services to post or transmit any material that is abusive, defamatory, fraudulent, obscene, or otherwise objectionable. You agree to provide accurate, current, and complete information as required for the Services.

For Clients

You agree to provide accurate and detailed information about your company and the job opportunities you are looking to fill. You are responsible for your hiring decisions, including conducting your own interviews, background checks, and reference checks. You agree to comply with all applicable employment and anti-discrimination laws.

For Candidates

You agree to provide accurate and truthful information in your resume, profile, and during the interview process. You acknowledge that ReqOpen does not guarantee employment and that any job offers are at the sole discretion of the hiring Client.

3. Fees and Payment

Our fees for recruitment services are payable by Clients upon the successful placement of a Candidate, as detailed in a separate service agreement between ReqOpen and the Client. All fees are non-refundable unless otherwise specified in the service agreement. There are no fees for Candidates to use our Services.

4. Intellectual Property

All content on the ReqOpen.com website, including text, graphics, logos, and software, is the property of ReqOpen or its content suppliers and is protected by international copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

5. Confidentiality

Both parties agree to keep confidential all information concerning the business, affairs, customers, clients, or suppliers of the other party. This includes Candidate information shared with Clients and Client information shared with Candidates. This obligation of confidentiality will survive the termination of our Services.

6. Limitation of Liability

To the fullest extent permitted by law, ReqOpen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.

7. Indemnification

You agree to indemnify and hold harmless ReqOpen, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your -violation of these Terms.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Bangalore, India to resolve any legal matter arising from the Terms.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
